1.0       Definition of Terms

1.1       The First World War Centenary Battlefield Tours Programme (the “Programme”) has been funded by the Department for Education (“DfE”) and is being provided by the UCL Institute of Education (UCL).

1.2       The Programme website (www.centenarybattlefieldtours.org) is operated by the UCL Institute of Education, University College London, 20 Bedford Way, London WC1H 0AL (“IOE”).

1.3       Use of the Programme website whether as a guest or a registered user is subject to these terms of use. Users who do not accept these terms of use are not authorised to use or continue using this website. Use of this website includes accessing, browsing or registering to use this website.

1.4       The Programme may amend these terms of use at any time and any revised version will be effective immediately upon being displayed on this website.

1.5       In the event of any comments or questions concerning these terms of use, users should contact the Programme by emailing ww1enquiries@ucl.ac.uk.

2.0       Intellectual property rights of the Programme

2.1       The Programme owns or is licensed to use all intellectual property rights in and to this website and the materials published on it, including without limitation the names and logos of the Programme, DfE and UCL and all technical infrastructure relating to this website. These works are protected by laws and treaties around the world. All such rights are reserved.

3.0       Access to and use of this website

3.1       In using any part of this website, users agree:

(a)        not to misuse or use this website in such a way that disrupts, interferes with or restricts the use of this website by other users;

(b)        not to upload, display or transmit any materials through this website which are false, offensive, defamatory, threatening, obscene, abusive, menacing, indecent, unlawful or which violate, breach or infringe the rights of any other person anywhere in the world (including, without limitation, any intellectual property rights);

(c)        to be liable to UCL and indemnify UCL for any breach of clause 3.1 (b) above (this means that the user will be responsible for any loss or damage UCL suffer as a result of a breach of clause 3.1(b) above.

(d)        not to breach any laws or otherwise infringe the copyright, trade mark or other rights of any other person anywhere in the world using this website;

(e)        not to reverse engineer, decompile, copy or adapt any software or other code or scripts forming part of this website, attempt to transmit to or via this website any information that contains a virus, worm, Trojan horse, logic bomb or other malicious, technologically harmful or disruptive material;

(f)        not to change, modify, delete, interfere with or misuse data contained on this website including any data entered by or relating to any third party user of this website;

(g)        not to attempt to gain access to this website, the server on which this website is stored or any server, computer or database connected to this website; and

(h)        not to attempt to attack this website via a denial-of-service or a distributed denial-of-service attack.

3.2       The Programme reserves the right to inspect and moderate all content uploaded, displayed or transmitted through this website and the Programme may, at its sole discretion, amend or remove any and all such content.

3.3       Users may print-off and may download materials, page(s) and extracts of any page(s) from this website for the user’s personal use or internal circulation within the user's organisation provided that the user must not modify the paper or digital copies of any materials the user has printed off or downloaded in any way and must not remove, overprint, or deface any trade mark, copyright or other proprietary notices contained in or appearing on such materials in whole or in part. The user must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Material contained in this website, or the battlefields tours may not otherwise be printed, downloaded, copied, reproduced or redistributed in whole or in part without the prior written consent of the Programme (please contact ww1enquiries@ucl.ac.uk). In particular material from this website, or the battlefield tours must not be reproduced or exploited for commercial gain. All other rights are reserved and users must ask permission from the Programme before making any other use of material contained in this website or used on the battlefield tours. This permission to reproduce material does not extend to material identified as belonging to third parties, where users must obtain the permission of the relevant owners before reproducing such material.

3.4       Where users upload, display and/or transmit materials through this website they agree to such material being used in accordance with these terms of use.

4.0       Use of discussion forums, blogs and wikis and messages, information and materials from users

4.1       From time to time there may be discussion forums, blogs, wikis or other social media functions held or hosted on this website. The Programme operates a "notice and take down" policy and in addition reserves the right at any time at its sole discretion to edit and/or remove any message or information posted to any discussion forum, blog,  wiki or any other social media function on this website. In the event of any complaints in respect of any message or information posted to any discussion forum, blog, wiki or any other social media function on this website, users should email ww1enquiries@ucl.ac.uk.

4.2       The Programme may also take steps to prevent users using any discussion forum, blog, wiki or other social media function on this website if it appears to the Programme that such users are creating problems for other users, exposing the Programme, DfE, and UCL to legal or financial risk and/or are in breach of these terms of use. All other rights are reserved.

4.3       Any material uploaded, displayed, posted and/or transmitted by users will be considered non-confidential and non-proprietary, and the Programme will have the right to use, copy, distribute and disclose to third parties any such content for any purpose.

4.4       The Programme also has the right to disclose a user’s identity to:

(a)        any third party who is claiming that any material uploaded, displayed, posted and/or transmitted by a user to this website constitutes a violation of their intellectual property rights, their right of privacy or any other legal right.

(b)        the relevant law enforcement agencies in the event that a user is suspected of committing a criminal offence under the Computer Misuse Act 1990 or otherwise, anywhere in the world.

5.0       User names and passwords

5.1       There are certain parts of this website which are for registered users only and users will be required to use a password and username to gain access to those “registered user only” parts of this website. Users agree:

(a)        to ensure that any details supplied to the Programme in order to register as a registered user are accurate and to advise the Programme promptly in the event that any such details change;

(b)        to keep confidential any personal login password provided by the Programme and to be responsible for any loss or damage resulting from use of any such password by any third party; and

(c)        to promptly notify the Programme where the user knows or suspects someone else knows the user’s password.

5.2       The Programme reserves the right to disable and/or terminate the registered user's access to and/or password(s) for the “registered user only” parts of this website if, in the reasonable opinion of the Programme, the user is using this website in a manner detrimental to this website or to other users or has failed to comply with any of the provisions of these terms of use.

6.0       Privacy policy

6.1       The website’s Privacy Policy www.centenarybattlefieldtours.org/information/privacy-policy/ sets out the terms on which the Programme processes any personal data the Programme collect from users, or that users provide to the Programme. By using this website, users consent to such processing and warrant that all data that the user provides is accurate.

7.0       Links

7.1       Links from this website are provided for information and convenience only. The Programme has no control over and cannot therefore accept responsibility or liability for the content of any linked third party website. The Programme does not endorse any linked website.

8.0       Exclusions and limitations of liability

8.1       Owing to the nature of the Internet the Programme cannot guarantee that this website, or any content on it, or any of the websites to which this website is linked will always be available to users or be uninterrupted. Access to this website is permitted on a temporary basis and the Programme may suspend, withdraw, discontinue or change all or any part of this website without notice. The Programme will not be liable to the user if for any reason this website is unavailable at anytime or for any period.

8.2       The Programme does not guarantee that this website will be secure or free from bugs or viruses. Users are responsible for configuring their information technology, computer programmes and platform in order to access this website. Users should ensure that they have appropriate protection against viruses and other security arrangements in place whilst using the Internet.

8.3       This website has been prepared with the aim of providing key information about the Programme. The content of this website is provided for general information only and does not constitute advice on which the user should rely. Although every reasonable effort has been made to ensure that the content on this website is up to date, it is subject to variation at any time without notice.

9.0       Jurisdiction

9.1       This website has been designed and these terms of use shall be governed by and construed in accordance with English law. The User hereby submits to the non-exclusive jurisdiction of the English courts.
