1.0 Definition of Terms
1.1 The First World War Centenary Battlefield Tours Programme (the “Programme”) has been funded by the Department for Education (“DfE”) and is being provided by the UCL Institute of Education and STG Travel Limited trading as Equity (“Equity”).
1.2 The Programme website (www.centenarybattlefieldtours.org) is operated by the UCL Institute of Education, University College London, 20 Bedford Way, London WC1H 0AL (“IOE”).
2.0 Intellectual property rights of the Programme
2.1 The Programme owns or is licensed to use all intellectual property rights in and to this website and the materials published on it, including without limitation the names and logos of the Programme, DfE, IOE and Equity and all technical infrastructure relating to this website. These works are protected by laws and treaties around the world. All such rights are reserved.
3.0 Access to and use of this website
3.1 In using any part of this website, users agree:
(a) not to misuse or use this website in such a way that disrupts, interferes with or restricts the use of this website by other users;
(b) not to upload, display or transmit any materials through this website which are false, offensive, defamatory, threatening, obscene, abusive, menacing, indecent, unlawful or which violate, breach or infringe the rights of any other person anywhere in the world (including, without limitation, any intellectual property rights);
(c) to be liable to IOE and indemnify IOE for any breach of clause 3.1 (b) above (this means that the user will be responsible for any loss or damage IOE suffer as a result of a breach of clause 3.1(b) above.
(d) not to breach any laws or otherwise infringe the copyright, trade mark or other rights of any other person anywhere in the world using this website;
(e) not to reverse engineer, decompile, copy or adapt any software or other code or scripts forming part of this website, attempt to transmit to or via this website any information that contains a virus, worm, Trojan horse, logic bomb or other malicious, technologically harmful or disruptive material;
(f) not to change, modify, delete, interfere with or misuse data contained on this website including any data entered by or relating to any third party user of this website;
(g) not to attempt to gain access to this website, the server on which this website is stored or any server, computer or database connected to this website; and
(h) not to attempt to attack this website via a denial-of-service or a distributed denial-of-service attack.
3.2 The Programme reserves the right to inspect and moderate all content uploaded, displayed or transmitted through this website and the Programme may, at its sole discretion, amend or remove any and all such content.
3.3 Users may print-off and may download materials, page(s) and extracts of any page(s) from this website for the user’s personal use or internal circulation within the user's organisation provided that the user must not modify the paper or digital copies of any materials the user has printed off or downloaded in any way and must not remove, overprint, or deface any trade mark, copyright or other proprietary notices contained in or appearing on such materials in whole or in part. The user must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Material contained in this website, or the battlefields tours may not otherwise be printed, downloaded, copied, reproduced or redistributed in whole or in part without the prior written consent of the Programme (please contact email@example.com). In particular material from this website, or the battlefield tours must not be reproduced or exploited for commercial gain. All other rights are reserved and users must ask permission from the Programme before making any other use of material contained in this website. This permission to reproduce material does not extend to material identified as belonging to third parties, where users must obtain the permission of the relevant owners before reproducing such material.
4.0 Use of discussion forums, blogs and wikis and messages, information and materials from users
4.1 From time to time there may be discussion forums, blogs, wikis or other social media functions held or hosted on this website. The Programme operates a "notice and take down" policy and in addition reserves the right at any time at its sole discretion to edit and/or remove any message or information posted to any discussion forum, blog, wiki or any other social media function on this website. In the event of any complaints in respect of any message or information posted to any discussion forum, blog, wiki or any other social media function on this website, users should email firstname.lastname@example.org.
4.3 Any material uploaded, displayed, posted and/or transmitted by users will be considered non-confidential and non-proprietary, and the Programme will have the right to use, copy, distribute and disclose to third parties any such content for any purpose.
4.4 The Programme also has the right to disclose a user’s identity to:
(a) any third party who is claiming that any material uploaded, displayed, posted and/or transmitted by a user to this website constitutes a violation of their intellectual property rights, their right of privacy or any other legal right.
(b) the relevant law enforcement agencies in the event that a user is suspected of committing a criminal offence under the Computer Misuse Act 1990 or otherwise, anywhere in the world.
5.0 User names and passwords
5.1 There are certain parts of this website which are for registered users only and users will be required to use a password and username to gain access to those “registered user only” parts of this website. Users agree:
(a) to ensure that any details supplied to the Programme in order to register as a registered user are accurate and to advise the Programme promptly in the event that any such details change;
(b) to keep confidential any personal login password provided by the Programme and to be responsible for any loss or damage resulting from use of any such password by any third party; and
(c) to promptly notify the Programme where the user knows or suspects someone else knows the user’s password.
